Stephen Garcia is receiving a California Lawyer of the Year for his work on behalf of the elderly. He is cited in part for his work in lawsuits against Extendicare facilities in Washington and Minnesota where he pioneered the effort to allege that the facilities claims didn’t match up with reality allowing him to sue Extendicare and other facilities for misrepresentation under California’s Legal Remedies Act.
This sounds like similar to the charges made in Minnesota against Extendicare that were dismissed by a federal judge. I wonder if the judge in his dismissal was signalling that Minnesota law unlike California law couldn’t support such claims. I’m still perplexed why the judge sided with Extendicare.
