Employer screening confusion – Facebook ok?

This article suggests that recruiters aren’t always informed about the risks of utilizing social networking to screen potential employees.  A college recruiting director says that there nothing wrong with employers using social networking sites to check on candidates.

It’s not at all clear that employers can indiscriminately use social networking websites like Facebook to eliminate potential candidates.  If a potential employee can prove an employer excluding him based on race, gender or age, by finding out this information on a social networking site, he or she might have a lawsuit.  There is also the new Genetic Information Non-Discrimination Act (GINA) which could be interpreted as prohibiting employers from using social networking sites for screening purposes.
